1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to Easy Load & Go. These Terms of Service (“Terms”) govern your access to and use of the services provided by Easy Load & Go (“Company,” “we,” “us,” or “our”), including but not limited to our website located at easyloadgo.com, and any moving transport or junk removal services you request, schedule, or receive from us.

BY REQUESTING, SCHEDULING, OR UTILIZING ANY SERVICE OFFERED BY EASY LOAD & GO, YOU (“CLIENT,” “YOU,” OR “YOUR”) EXPLICITLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, AS WELL AS OUR SEPARATE POLICIES & PROCEDURES AND PRIVACY POLICY, WHICH ARE HEREBY INCORPORATED BY REFERENCE. If you do not agree with any part of these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and2 Easy Load & Go.

2. DESCRIPTION OF SERVICES

Easy Load & Go provides specialized hauling services within the Houston, Texas market. Our services are distinct in their operational scope:

• 2.1. Moving Services (Transport Only): We provide a professional driver, a truck, and a trailer for the transportation of your pre-packed and pre-loaded personal items. Crucially, Easy Load & Go personnel do NOT provide labor for packing, loading, or unloading your items, nor do we enter any residential or commercial buildings. You are solely responsible for all physical handling of your belongings.

• 2.2. Junk Removal Services (Transport with Labor from Outdoor Locations): We provide a professional driver, a truck, a trailer, and labor to load your unwanted, non-hazardous items from a designated accessible outdoor location onto our trailer for transport and disposal. Easy Load & Go personnel do NOT enter any residential or commercial buildings or structures to remove items. All items must be brought to an accessible outdoor area by you.

3. CLIENT RESPONSIBILITIES AND OBLIGATIONS

By engaging Easy Load & Go, you agree to the following responsibilities and obligations:

• 3.1. Accuracy of Information: You warrant that all information provided to Easy Load & Go during the quote request, booking, and service execution process (including but not limited to item descriptions, addresses, access conditions, and contact details) is accurate, complete, and truthful. Any misrepresentation may result in revised pricing or refusal of service.

• 3.2. Compliance with Policies: You agree to strictly adhere to all operational guidelines, limitations, and prohibitions outlined in our Policies & Procedures, including but not limited to:

• The “No Indoor Entry Policy” for all services.

• Your sole responsibility for packing, loading, and unloading for Moving Services.

• Ensuring items for Junk Removal are consolidated and accessible outdoors.

• Prohibitions against hazardous materials, illegal items, and items of extraordinary value.

• Ensuring safe and legal access for our truck and trailer at all locations.

• 3.3. Preparation of Items: You are responsible for properly preparing all items for service as detailed in our Policies & Procedures, including packing, disconnecting appliances, and ensuring non-hazardous content.

• 3.4. On-Site Presence: An authorized adult (18 years or older) must be present at both pickup and delivery locations throughout the entire service duration to direct our team, confirm items, and approve completion of work.

• 3.5. Safety: You are responsible for ensuring a safe environment for our personnel, including securing pets and children away from the work area.

• 3.6. Payment: You agree to make full payment for services rendered immediately upon completion, as per the agreed-upon final quote.

4. PRICING, PAYMENT, AND BILLING

• 4.1. Quotes: Preliminary quotes are estimates based on your provided information and are subject to revision upon on-site assessment. The final price will be confirmed with you before any work commences.

• 4.2. Pricing Structure: Our detailed pricing information is available on our website at easyloadgo.com/pricing and in our Policies & Procedures.

• 4.3. Payment Terms: Full payment is due upon completion of services. We accept Cash, Credit/Debit Card, and E-transfer.

• 4.4. Late Payments: Any unpaid balances will accrue a late fee of 1.5% per month (18% per annum) or the maximum allowed by Texas law, whichever is less, from the date service was rendered. You agree to pay all collection costs, including reasonable attorney’s fees, incurred by Easy Load & Go to collect any overdue amounts.

5. CANCELLATIONS, RESCHEDULING, AND REFUSAL OF SERVICE

• 5.1. Client-Initiated: Cancellations or rescheduling requests made less than twenty-four (24) hours prior to the scheduled service time will incur a fee of $50.00. No-shows will result in a charge equivalent to the minimum service fee for the booked service type.

• 5.2. Company-Initiated Refusal/Cancellation: Easy Load & Go reserves the absolute right to refuse or cancel service, either prior to or upon arrival, due to safety concerns, misrepresentation of job scope, non-compliance with our “No Indoor Entry Policy” or other Policies & Procedures, or unforeseen operational issues. In such cases, a service fee for travel and on-site assessment (minimum $50.00) may be applied, and any deposit paid may be forfeited if the refusal is due to Client non-compliance. 6. DISCLAIMERS

• 6.1. Service “As Is”: Easy Load & Go provides its services on an “as is” and “as available” basis.3 We make no warranties or representations, express or implied, regarding the outcome, speed, or specific results of our services beyond those explicitly stated herein.

• 6.2. Website “As Is”: The easyloadgo.com website and its content are provided “as is” without any warranties4 of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Easy Load & Go does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

• 6.3. No Professional Advice: Information provided on our website or by our personnel is for general informational purposes only and does not constitute professional advice (e.g., legal, financial, or engineering advice).

7. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EASY LOAD & GO, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,5 CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR WEBSITE, EVEN IF EASY LOAD & GO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EASY LOAD & GO’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES PROVIDED, WHETHER IN CONTRACT, TORT6 (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO EASY LOAD & GO FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

SPECIFIC LIMITATIONS ON LIABILITY FOR DAMAGE TO ITEMS ARE DETAILED IN SECTION 6 OF OUR POLICIES & PROCEDURES, INCLUDING A MAXIMUM AGGREGATE LIABILITY OF FIVE HUNDRED DOLLARS ($500.00) PER INCIDENT FOR DAMAGE PROVEN TO BE DIRECTLY CAUSED BY EASY LOAD & GO’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT DURING THE TRANSPORTATION PHASE (FOR MOVING) OR LOADING PHASE (FOR JUNK REMOVAL).

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Easy Load & Go, its owners, employees, and agents from and against any and all claims,7 liabilities, losses, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

• Your breach of these Terms or any of our Policies & Procedures.

• Your acts or omissions during the loading/unloading process for Moving Services.

• The presence of prohibited items or hazardous materials on your property.

• Any property damage or personal injury occurring on your premises that is not directly caused by the gross negligence or willful misconduct of Easy Load & Go personnel.

• Any dispute regarding ownership of items removed.

• Your use of our website.

9. FORCE MAJEURE

Easy Load & Go shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay8 is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war,9 terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages10 of transportation facilities, fuel, energy, labor, or materials.

10. GOVERNING LAW AND DISPUTE RESOLUTION

• 10.1. Governing Law: These Terms of Service shall be governed by11 and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

• 10.2. Binding Arbitration: Any dispute, controversy, or claim arising12 out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered13 by the American Arbitration Association14 in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Houston, Texas. The decision of the arbitrator(s) shall be final and binding upon both parties, and judgment15 upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

• 10.3. Waiver of Class Action: You agree that any arbitration or proceeding shall be limited to the dispute between Easy Load & Go and you individually. To the full16 extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

11. INTELLECTUAL PROPERTY

All content on the easyloadgo.com website, including text, graphics, logos, images, and software, is the property of Easy Load & Go or its content suppliers and is protected17 by United States and international copyright laws. You may not18 reproduce, distribute, modify, or create derivative works of any content without our express written permission.

12. SEVERABILITY

If any provision of these19 Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction,20 such provision shall be severed from these Terms, and the remaining provisions shall remain21 in full force and effect.

13. ENTIRE AGREEMENT

These Terms of Service, together with our Policies & Procedures and Privacy Policy, constitute the entire agreement between you and Easy Load & Go concerning your use of our services and website, superseding any prior or contemporaneous agreements, proposals, or communications, whether oral or written.

14. AMENDMENTS

Easy Load & Go reserves the right to amend or update these Terms22 of Service at any time. Any changes will be effective immediately upon posting on our website (easyloadgo.com). It is your responsibility to review these Terms periodically. Your continued use of our services or website after any such changes constitutes your acceptance of the revised Terms of Service.
